1. Purpose and acceptance

1.1. The purpose of these General Terms and Conditions of Use (hereinafter referred to as "GTCU") is to define the terms and conditions under which users (hereinafter referred to as "the User" or "You") may access and use the website accessible at the following address https://geekworkers.ch (hereinafter "the Site"), published by Geekworkers Sàrl.

1.2. Access to and use of the Site implies full and unreserved acceptance of these GCU by the User. If you do not accept these conditions, please do not use the Site.

1.3. Geekworkers Sàrl reserves the right to modify these Terms and Conditions at any time. The modifications will take effect as soon as they are published on the Site. It is the User's responsibility to consult the GCU regularly. Continued use of the Site after publication of the modifications shall constitute acceptance thereof.

3. Access to the Site

3.1. The Site is accessible free of charge to any User with Internet access. All costs relating to access to the Site (hardware, software, internet subscription, etc.) are the sole responsibility of the User.

3.2. Geekworkers Sàrl uses reasonable efforts to ensure quality access to the Site, but is under no obligation to do so.

3.3. Geekworkers Sàrl cannot be held responsible for any malfunction of the network or servers or any other event beyond reasonable control, which prevents or degrades access to the Site.

3.4. Geekworkers Sàrl reserves the right to interrupt, temporarily suspend or modify without notice access to all or part of the Site, in order to carry out maintenance, or for any other reason, without the interruption giving rise to any obligation or compensation.

4. Intellectual Property

4.1. All the elements making up the Site (text, graphics, logos, images, videos, sound, software, structure, databases, etc.), as well as the Site itself, are subject to Swiss and international legislation on copyright and intellectual property.

4.2. All rights of reproduction and representation are reserved, including for downloadable documents and iconographic and photographic representations. The "Geekworkers" brand and logo are registered trademarks.

4.3. Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the Site, whatever the means or process used, is prohibited, except with the prior written authorisation of Geekworkers Sàrl.

4.4. Any unauthorised use of the Site or of any of the elements it contains will be considered to constitute an infringement and will be prosecuted in accordance with the legal provisions in force.

4.5. The User undertakes to use the Content of the Site for strictly private or informational purposes. Use for commercial purposes is strictly forbidden without prior authorisation.

5. Obligations of the User

5.1. The User undertakes to use the Site in accordance with these GTCU, Swiss law, public order and good morals.

5.2. In particular, the User undertakes not to:

  • Infringe in any way whatsoever the rights of Geekworkers Sàrl or third parties (in particular copyrights, trademarks).
  • Use the Site for illicit, prohibited or defamatory purposes.
  • Attempt to obtain unauthorised access to the Site or related systems.
  • Disrupt or attempt to disrupt the proper operation of the Site.
  • Providing inaccurate or misleading information when using contact forms or other interactions.

6. Protection of Personal Data

6.1. Geekworkers Sàrl undertakes to protect Users' personal data in accordance with its Privacy Policy. Privacy policyavailable via the dedicated link on this site.

6.2. The Privacy Policy forms an integral part of these GTC. It details the data collected via the Site (in particular via forms and cookies), the purposes and legal basis of the processing, Users' rights and how to exercise them.

6.3. By using the contact or quote request forms on the Site, the User consents to Geekworkers Sàrl collecting and processing the information provided (surname, first name, email, telephone, project information) in order to respond to his/her request, in accordance with the Privacy Policy.

6.4. For sensitive information relating to projects discussed via the Site, Geekworkers proposes the signature of a Confidentiality Agreement (NDA).

7. Limitation of liability

7.1. The information and content on the Site are provided for information purposes only. Geekworkers Sàrl endeavours to ensure that this information is accurate but cannot guarantee that it is exhaustive, up-to-date or suitable for any particular purpose.

7.2. Geekworkers Sàrl cannot be held responsible for any errors or omissions or for the use that may be made of this information. The User is solely responsible for the proper use, with discernment and a critical mind, of the information made available on the Site.

7.3. Geekworkers Sàrl declines all responsibility for direct or indirect damage (such as loss of data, financial loss, loss of opportunity, immaterial damage) which may result from access to or use of the Site, including inaccessibility, loss of data, deterioration, destruction or viruses which may affect the User's computer equipment, and/or the presence of viruses on its site. Its liability is limited to the maximum extent permitted by Swiss law.

8. Hypertext links

8.1. The Site may contain hypertext links to other sites on the Internet. Links to these other resources will cause you to leave the Site. https://geekworkers.ch.

8.2. Geekworkers Sàrl has no control over the content of these third-party sites and accepts no responsibility for their content, accuracy, legality or operation. The decision to activate these links is the full and entire responsibility of the User.

9. Maintenance & Availability

9.1. Geekworkers Sàrl endeavours to keep the Site accessible 7 days a week and 24 hours a day. However, maintenance of the Site or the hosting servers (provided by Infomaniak in Switzerland), updates or other technical events may lead to temporary interruptions in access without prior notice.

9.2. Geekworkers Sàrl cannot be held responsible for these interruptions and the consequences that may result for the User.

10. Force Majeure

Geekworkers Sàrl cannot be held responsible if the non-execution or the delay in the execution of one of its obligations described in these GCU results from a case of force majeure (as defined by Swiss law and jurisprudence), including in particular natural disasters, governmental acts, major breakdowns of telecommunication or electricity networks.

11. Modification of the Terms of Use

Geekworkers Sàrl reserves the right to modify, at any time and without notice, these GTC in order to adapt them to changes in the Site and/or its operation. The applicable version is that in force at the time of use of the Site by the User.

12. Applicable Law and Jurisdiction

12.1. These GCU are subject to the Swiss law.

12.2. In the event of a dispute concerning the interpretation, performance or validity of these GCU, and in the absence of an amicable solution, exclusive jurisdiction is given to the ordinary courts of the Canton of VaudSwitzerland, subject to appeal to the Federal Court.
