Welcome to the Geekworkers website (https://geekworkers.ch). Geekworkers Sàrl, based in French-speaking Switzerland near Lausanne, is committed to protecting the privacy and personal data of its visitors and clients.

This privacy policy explains what information we collect, how we use it, share it and protect it, including through the use of cookies and similar technologies. It also informs you of your rights regarding your personal data. We comply with the European Union's General Data Protection Regulation (GDPR) and the Swiss Federal Data Protection Act (DPA).

3. Personal data we collect

We collect different types of personal data about you:

  • Identification and contact details : When you fill in a form on our site (via WS Form PRO), we collect the information you provide, such as your first name, surname, e-mail address and telephone number.
  • Information about your project : Through our forms, we may collect additional information about your project so that we can better understand your needs and respond effectively. We understand the sensitivity of this information and offer you the possibility of requiring the signature of a confidentiality agreement (NDA) before or during our exchanges.
  • Technical and browsing data (including via cookies) : When you browse our site, we automatically collect certain information via cookies, pixels and similar technologies (managed by Google Tag Manager), as well as via our server logs. This data may include your IP address (potentially anonymised), the type of browser and device used, the operating system, the pages visited, the duration of the visit, the actions carried out (clicks, scrolling) and the sources of traffic (referring sites). Specific tools such as Google Analytics 4 and Microsoft Clarity contribute to this collection (see Section 7).
  • Safety data : To protect our site against form spam, we use WP Armour - Honeypot Anti Spam, which can process minimal technical data (such as IP address) automatically. Server logs also collect technical data for security and diagnostic purposes.
  • Consent data : We record your cookie consent preferences via our Complianz tool.

4. Purposes of Data Processing

We use your personal data for the following purposes:

  • Responding to your requests: Process and respond to your questions, requests for quotes or contact requests submitted via our forms (WS Form PRO).
  • Providing our services: Executing contracts and providing services that you order from us.
  • Improve our website and services: Analyse the use of our site (via Google Analytics 4 and Microsoft Clarity) to understand how visitors interact with our content, identify friction points and optimise the user experience and our offers.
  • Marketing and Advertising: To measure the effectiveness of our advertising campaigns (Google Ads) and potentially offer you targeted advertising (remarketing) on other sites, subject to your consent.
  • Security: Ensuring the security of our website, preventing fraud, abuse and attacks (in particular via WP Armour and server logs).
  • Technical operation: Ensuring the smooth technical operation of the website (essential cookies).
  • Consent management: Save and respect your choices concerning cookies.
  • Legal compliance: Meeting our Swiss legal and regulatory obligations.

5. Legal basis for processing

We process your personal data on the following legal grounds:

  • Your consent : For the use of non-essential cookies (Functional, Analytical, Marketing) and the sending of any direct marketing communications (e.g. newsletter if applicable). You may withdraw your consent at any time (see sections 6 and 13).
  • Performance of a contract or pre-contractual measures : When you contact us via a form to request a service or a quote, or when we perform a contract with you.
  • Our Legitimate Interests : To ensure the security of our website (WP Armour, server logs), for the basic technical operation of the site (strictly necessary cookies), and potentially to analyse in an aggregated and anonymised manner the use of the site for internal improvement purposes (subject to a favourable balance of interests and provided that this does not override your rights).
  • Our legal obligations : If we are required to process your data to comply with Swiss law.

6. Use of Cookies and Similar Technologies

a) What are cookies?

Cookies are small text files placed on your browser (computer, tablet, smartphone) when you visit our website. They are used to store information temporarily or persistently. We also use similar technologies such as pixels (small invisible images) or local browser storage for similar functionalities.

b) Why do we use cookies?

We use cookies for a number of reasons: to ensure the technical operation of the site, to secure the site, to remember your preferences (such as your consent choices), to understand how you interact with our site in order to improve it, to measure the effectiveness of our marketing actions and to offer you potentially more relevant advertising.

c) Types of cookies used :

We classify the cookies we use (directly or via third-party tools) into several categories:

  • Strictly Necessary Cookies : They are essential for the technical operation and security of the site. They cannot be deactivated via our consent tool. They include, for example, session cookies, form security cookies and the cookie that remembers your consent preferences (via Complianz). These cookies are generally set on the basis of our legitimate interests. WordPress and Elementor may also use this type of cookie for their basic operation.
  • Functional cookies : Allow us to remember your choices and preferences (e.g. language) to improve your experience. Their use is subject to your consent.
  • Analytical (or Performance/Statistical) cookies : It helps us to understand how visitors use our site (pages visited, time spent, traffic sources, etc.). The data collected is generally aggregated or pseudonymised (e.g. via Google Analytics 4 with IP anonymisation activated) or used for behavioural analysis (e.g. via Microsoft Clarity for heatmaps/recordings). Their use is subject to your consent.
  • Marketing (or advertising) cookies : Used to track your browsing habits, sometimes on several sites, in order to understand your centres of interest and offer you more relevant advertising (remarketing) or measure the effectiveness of our campaigns (conversion tracking, etc.). d) Third-party cookies :

Some cookies are set by third-party services that we use, such as Google (for Analytics and Ads) and Microsoft (for Clarity). We have no direct control over these third-party cookies once you have consented to their use via our tool. e) Management of your Consent (Complianz) :

We use the Complianz Privacy Suite (Premium) tool to manage your consent to non-essential cookies.

  • Consent banner : On your first visit, a banner will appear allowing you to accept all cookies, refuse those that are not strictly necessary, or personalise your choices by category (Functional, Analytics, Marketing).
  • Conditional activation : No non-strictly necessary cookies are activated before you have given your explicit consent.
  • Modification/Withdrawal of Consent : You can change your preferences or withdraw your consent at any timevery easily. To do so, click on the link "Managing consent which is permanently accessible in the footer of our site. This will reopen the Complianz management panel where you can adjust your choices. Withdrawal of consent does not affect the lawfulness of processing based on consent prior to such withdrawal.

f) How long cookies are kept :

The lifetime of cookies varies: some are session cookies (deleted when you close your browser), others are persistent and remain on your device for a set period of time. You can generally find detailed information on the specific lifetime of each cookie via the interface of our consent management tool (Complianz).

g) Browser settings :

You can also configure your web browser to block some or all cookies, or to alert you when cookies are being sent. However, blocking strictly necessary cookies may affect the proper functioning of the site. Management via our Complianz tool is the recommended method for controlling cookies specific to our site.

7. Use of specific tools

  • Complianz Privacy Suite (Premium) : As described above, manages the collection, storage and modification of your consent for cookies.
  • Google Tag Manager (GTM): Tag container enabling us to deploy third-party scripts (GA4, Ads, Clarity) conditionally, depending on the consent obtained by Complianz.
  • Google Analytics 4 (GA4): Audience analysis tool. Purpose: To understand how the site is used in order to improve it. Data: Interactions, pages viewed, technical/geographical information (anonymised IP activated). Legal basis: Consent. Service provider: Google LLC (USA). Google Privacy Policy.
  • Google Ads: Advertising platform. Purpose: Tracking conversions from our ads, remarketing. Data: Cookies/advertising pixels, browsing data. Legal basis: Consent. Service provider: Google LLC (USA). Google Privacy Policy.
  • Microsoft Clarity : Behavioural analysis tool. Purpose: To understand UX via heatmaps/session logs in order to optimise the site. Data: Interactions (clicks, scrolls), technical data (pseudonymised). Legal basis: Consent. Service provider: Microsoft Corporation (USA). Microsoft privacy statement.
  • WS Form PRO : Forms plugin. Purpose: To collect your contact/quotation requests. Data: The data you enter (name, email, telephone number, project, etc.). Legal basis: Pre-contractual measures.
  • WP Armour - Honeypot Anti Spam : Anti-spam plugin. Purpose: Form security. Data: Minimal technical processing (e.g. IP). Legal basis: Legitimate interest.
  • WordPress & Elementor : Platform and builder of our site. May use essential technical cookies. Legal basis: Legitimate interest.

8. Sharing of Personal Data

We do not sell your personal data. We may share certain data with third parties only where necessary and with appropriate safeguards:

  • Web host : Our site and your data are securely hosted in Swiss by our partner Infomaniak.
  • Suppliers of analysis and advertising tools : Google (Analytics, Ads - our Google Partner) and Microsoft (Clarity), depending on the consent you have given via Complianz.
  • Technical service providers : Any sub-contractors (e.g. for advanced maintenance) are subject to contractual confidentiality and security obligations.
  • Competent authorities: If Swiss law requires us to do so.

9. International Data Transfers

The main accommodation is in Swiss. However, the use of tools such as Google Analytics, Google Ads and Microsoft Clarity may involve the transfer of data (generally pseudonymised or aggregated) to servers located outside Switzerland/EEA, mainly in the United States. We ensure that these transfers are governed by recognised protection mechanisms (e.g. appropriate adequacy decision or Standard Contractual Clauses with additional measures, as provided for in the policies of these suppliers).

10. Data retention period

We keep your personal data only for as long as is necessary for the following purposes3 :

  • Form data: Kept for as long as necessary to process and follow up your request, and for a maximum of 3 years after our last contact if no contractual relationship is established, unless otherwise required by law (in particular an accounting retention period of 10 years if a contractual relationship is established).
  • Analytical data (GA4, Clarity): Limited duration and parameterised in the tools (e.g. 14 months for GA4), often in aggregated/pseudonymised form.
  • Cookie data : Variable durations (session or persistent). Details can be viewed via the interface of our consent management tool (Complianz).

11. Data security

We take the security of your data very seriously through technical and organisational measures: secure hosting in Switzerland via InfomaniakHTTPS protocol, firewall, access management, regular updates, staff awareness. For your sensitive project information, we offer to sign a confidentiality agreement (NDA).

12. Your rights regarding your personal data

In accordance with the Data Protection Act and the General Data Protection Regulation, you have the right to access, rectify, delete, limit, port, object to and oppose the use of your personal data. withdraw your consent at any time.4
