General Conditions Applicable to Geekworkers Ads Packs:
1. Setup Fees:
โข A single initial fee equivalent to deux (2) mensualitรฉs du pack choisi est facturรฉ le premier mois. Ce montant couvre l'audit initial, la dรฉfinition de la stratรฉgie, la configuration technique complรจte (comptes, tracking avancรฉ GA4/Pixel/API CAPI, GTM, Consent Mode v2), la configuration des premiรจres campagnes et la gestion du premier mois.
โข Le paiement de ce frais de setup se fait en une fois ร la signature du contrat, ou selon accord spรฉcifique.
2. Monthly Management:
โข ร partir du deuxiรจme mois, la gestion mensuelle est facturรฉe au tarif du pack choisi.
โข Pour le Pack Premium, la gestion mensuelle est composรฉe d'un fixe + un pourcentage du budget publicitaire rรฉellement dรฉpensรฉ le mois prรฉcรฉdent.
3. Advertising Budget:
โข The advertising budget is entirely at the customer's expense et payรฉ directement aux plateformes publicitaires (Google/Meta).
โข Ceci permet au client d'รฉconomiser la TVA (actuellement 8.1% en Suisse) qui serait applicable si Geekworkers refacturait le budget.
โข Le client est responsable de la gestion de sa mรฉthode de paiement auprรจs des plateformes et des รฉventuels dรฉpassements de budget.
โข Geekworkers recommande un budget minimum/plage de budget pour chaque pack, mais le montant final est dรฉcidรฉ par le client.
4. Commitment & Duration:
โข Un engagement initial minimal (gรฉnรฉralement 3 ou 6 mois selon les offres promotionnelles) est requis pour amortir la phase de setup et permettre l'optimisation des campagnes.
โข After the initial period, the contract is tacitly renewed from month to month, unless terminated by one of the parties with 30 days' notice before the end of the current month.
5. Services Included & Excluded:
โข Les prestations incluses sont dรฉtaillรฉes dans la section "Services Produit" de chaque pack.
โข Sauf mention contraire, la crรฉation d'assets publicitaires (visuels, vidรฉos) personnalisรฉs et avancรฉs (hors modรจles standards ou assets fournis par le client) n'est pas incluse et fait l'objet d'un devis sรฉparรฉ.
โข La crรฉation ou l'optimisation de landing pages n'est pas incluse par dรฉfaut.
6. Tracking & Consent:
โข La mise en place du tracking (GA4, GTM, Pixel Meta, API CAPI) et du Consent Mode v2 est une prioritรฉ et incluse dans le setup.
โข Le client doit s'assurer que son site web dispose d'une banniรจre de consentement conforme (CMP) et fournit les accรจs nรฉcessaires (site web, GTM, etc.). Geekworkers peut assister dans le choix et la configuration basique d'une CMP si besoin (prestation additionnelle possible).
7. Reporting & Communication:
โข Un rapport mensuel dรฉtaillรฉ est fourni, incluant les KPIs clรฉs, analyses et recommandations.
โข Des points de suivi peuvent รชtre organisรฉs selon les besoins et le pack.
8. Customer Responsibilities:
โข Fournir les accรจs nรฉcessaires (comptes pub, site web, GTM, Analytics, page Meta...).
โข Fournir les informations sur l'entreprise, les objectifs, les offres, la cible.
โข Fournir les assets de base (logo, charte graphique, รฉventuelles photos/vidรฉos existantes).
โข Valider les propositions stratรฉgiques et crรฉatives dans des dรฉlais raisonnables.
โข Assurer la conformitรฉ lรฉgale de ses offres et de son site web.
9. Confidentiality & Ownership:
โข Geekworkers s'engage ร la confidentialitรฉ des donnรฉes client.
โข Le client reste propriรฉtaire de ses comptes publicitaires et de ses donnรฉes.
10. Limitation of Liability:
โข Geekworkers s'engage ร une obligation de moyens, mettant en ลuvre son expertise pour atteindre les objectifs dรฉfinis.
โข Aucune garantie de rรฉsultats chiffrรฉs (ventes, leads) ne peut รชtre fournie, les performances dรฉpendant de nombreux facteurs externes (marchรฉ, concurrence, offre client...).
โข La responsabilitรฉ de Geekworkers est limitรฉe au montant des frais de gestion payรฉs.
11. Payment & Billing:
โข Le setup est facturรฉ ร la signature.
โข La gestion mensuelle est facturรฉe en dรฉbut de mois pour le mois ร venir.
โข Payment within 10 days net.
12. Modifications & Evolution:
โข Le client peut demander ร changer de pack (upgrade/downgrade) avec un prรฉavis, ajustant ainsi le niveau de service et le tarif pour le mois suivant.
13. Conflict Resolution:
